These Terms and Conditions ("Terms" or "Terms of Use") form a binding agreement between you and Linkkers Technologies Company ("Linkkers," "we," "us," or "our") and govern your access to and use of our website, applications, and AI-powered recruitment platform (together, the "Platform"). Please read them carefully.
1. Acceptance of These Terms
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you use the Platform on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf, and "you" includes that organization. If you do not agree, you must not use the Platform.
2. About Linkkers
The Platform is operated by Linkkers Technologies Company, a limited liability company registered in the Kingdom of Saudi Arabia (National Number: 7054832394). The Platform connects employers, recruiters, and their teams ("Business Users") with job seekers and candidates ("Candidates"), and provides services including job distribution, candidate search, skills assessments, AI-powered matching, and CV creation.
3. Eligibility and Accounts
- You must be at least 18 years old to use the Platform.
- You must provide accurate, current, and complete information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- You must notify us promptly if you suspect unauthorized access to your account.
- You may not create an account on behalf of another person without their authorization.
4. Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Platform for its intended recruitment purposes. You agree not to:
- Use the Platform for any unlawful, fraudulent, discriminatory, or misleading purpose
- Post false, inaccurate, or misleading job listings or profile information
- Scrape, crawl, harvest, or export data from the Platform by automated means without our written consent
- Resell, sublicense, or redistribute Platform data or access to any third party
- Upload viruses, malicious code, or content that infringes the rights of others
- Attempt to gain unauthorized access to, interfere with, or disrupt the Platform or its infrastructure
- Reverse engineer, decompile, or copy any part of the Platform, except where the law expressly permits it
- Use the Platform to send unsolicited marketing or spam
5. Candidates
You are responsible for the accuracy of your profile, CV, and any information you submit. You control the visibility of your profile through your account settings, as described in our Privacy Policy.
Linkkers is not an employer or employment agency and does not guarantee that you will receive interviews, job offers, or employment. Hiring decisions are made solely by Business Users.
6. Business Users
If you use the Platform as a Business User, you agree that:
- Your job postings are genuine, lawful, and comply with applicable employment and anti-discrimination laws.
- You will use candidate data only for legitimate recruitment purposes within your own organization, and in compliance with applicable data protection laws, including PDPL and, where applicable, GDPR.
- You will not make employment or other eligibility decisions based solely on data sourced from the Platform, or profile candidates based on sensitive characteristics such as race, gender, nationality, religion, health, or political affiliation.
- You are solely responsible for your hiring decisions and for how you and your team members contact and engage with candidates, on or off the Platform.
- You are responsible for the actions of all users you authorize under your organization's account.
Breach of this section is a material breach of these Terms and may result in immediate suspension or termination of access.
7. AI Features
The Platform uses artificial intelligence to provide features such as job matching, candidate ranking, assessment scoring, and CV generation. AI-generated outputs are provided for informational purposes only, may not always be accurate or complete, and do not constitute professional advice or employment decisions. You should review AI outputs before relying on them. Candidates may request human review of automated decisions as described in our Privacy Policy.
8. Fees and Payment
Some features of the Platform may be offered for a fee. Where fees apply, pricing and payment terms are presented before purchase. Payments are processed by third-party payment processors, and applicable taxes, including VAT, apply as required by law.
9. Your Content and Intellectual Property
You retain ownership of the content you submit to the Platform, such as profiles, CVs, and job postings ("Your Content"). You grant Linkkers a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and display Your Content as necessary to operate, provide, and improve the Platform, in accordance with our Privacy Policy.
The Platform, including its software, design, trademarks, and all related intellectual property, is owned by Linkkers or its licensors. Nothing in these Terms transfers any ownership rights to you. If you provide feedback or suggestions, we may use them without any obligation to you.
10. Third-Party Services
The Platform may integrate with or link to third-party services, including job boards, applicant tracking systems, and login providers. Your use of those services is governed by their own terms and privacy policies. Linkkers is not responsible for the availability, content, or practices of third-party services.
11. Privacy
Our collection and use of personal data is described in our Privacy Policy and the full Privacy, AI & Data Use Policy, which form part of these Terms.
12. Suspension and Termination
You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if your use poses a risk to the Platform or other users. On termination, your right to use the Platform ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Linkkers disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or secure, or that any content, candidate, or job posting is accurate or reliable.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Linkkers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or relating to these Terms or the Platform.
Linkkers' total aggregate liability to you shall not exceed the greater of: (a) the total fees paid by you to Linkkers in the twelve (12) months preceding the claim; or (b) SAR 500 (five hundred Saudi Riyals). Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Linkkers and its officers, employees, and agents from any claims, losses, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, Your Content, or your breach of these Terms or applicable law.
16. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you by email or through the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia. Nothing in these Terms limits any non-waivable rights you may have under the mandatory laws of your country of residence.
18. General
- Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and Linkkers regarding the Platform.
- Severability: if any provision is found unenforceable, the remaining provisions remain in full effect.
- No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: you may not transfer your rights under these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Language: these Terms are published in English. Where an Arabic version is provided, the Arabic version prevails for users in the Kingdom of Saudi Arabia.
